Rolfstone (Sandbirds BV)
Article 1 - Definitions
In these terms and conditions, the following definitions apply:
- Cooling-off Period: The period within which the consumer can make use of their right of withdrawal.
- Consumer: The natural person not acting in the course of a trade, business, craft, or profession.
- Day: A calendar day.
- Business Day: Any day from Monday to Friday, excluding public holidays.
- Right of Withdrawal: The ability of the consumer to terminate the distance contract within the cooling-off period.
- Distance Contract: A contract concluded between the entrepreneur and the consumer within the framework of an organized system for distance selling, without simultaneous physical presence of the parties.
- Entrepreneur: Sandbirds BV, trading as Rolfstone, offering products to consumers remotely.

Article 3 - Applicability
- These terms and conditions apply to every offer from the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
- Before the agreement is concluded, the text of these terms and conditions is made available. If this is not reasonably possible, it will be indicated how the terms and conditions can be reviewed and that they will be sent free of charge upon request.
- In case of conflicting provisions, the terms most favorable to the consumer shall prevail.
Article 4 - The Offer
- Each offer contains a full and accurate description of the products offered. Illustrations and descriptions are as truthful as possible, but minor deviations may occur.
- Apparent mistakes or errors in the offer are not binding on the entrepreneur.
- The offer clearly states the rights and obligations associated with acceptance, such as price, delivery times, and applicable taxes.
Article 5 - The Agreement
- The agreement is established at the moment the consumer accepts the offer, agrees to the terms and conditions, and fulfills the payment obligation.
- If the agreement is concluded electronically, the entrepreneur shall confirm receipt of the order electronically.
- The entrepreneur takes appropriate measures to ensure the security of electronic data transfer.
Article 6 - Right of Withdrawal
- The consumer has the right to withdraw from the contract within 14 days without giving any reason.
- The cooling-off period begins the day after the consumer or a third party, not the carrier, receives the product.
- To exercise the right of withdrawal, the consumer must notify the entrepreneur via email (service@rolfstone.com) or WhatsApp (+31 6 83 993 993) within the cooling-off period.
- The consumer is responsible for demonstrating that the withdrawal was exercised correctly and in time.
- The entrepreneur provides a return label for free return of the product. If the consumer returns the product at their own expense, these costs will not be reimbursed unless otherwise agreed via email or WhatsApp.
- The consumer has 14 days after withdrawal notification to return the product.
- The product must be clean, undamaged, complete, and returned in its original packaging (excluding plastic seal). In case of damage, the consumer must contact the entrepreneur first.
- The product must be carefully packed in a sturdy shipping box to prevent damage during transport.
- The purchase amount will be refunded within 6 business days after receipt of the return. The refund will be made using the same payment method as the original purchase. No deviations from this policy are allowed.
- If the consumer exercises their right of withdrawal, all supplementary agreements are automatically terminated.
Article 7 - Consumer Obligations During the Cooling-off Period
- During the cooling-off period, the consumer must handle the product and packaging carefully. The product may only be unpacked and used to the extent necessary to determine its nature and functioning.
- For our wireless earbuds, this means you may test them for functionality, sound quality, and fit. These aspects are essential for making an informed decision. Please ensure hygienic use and return the earbuds clean and in their original packaging if you decide to return them.
- The consumer is liable for any depreciation in value resulting from use beyond what is necessary to determine the nature and functioning of the product.
Article 8 - Price and Payment
- Prices stated in the offer include VAT.
- Payment can be made via iDeal, Visa, Mastercard, Maestro, and Bancontact.
- Payment must be completed prior to delivery.
Article 9 - Delivery
- Orders placed before 23:00 are delivered the next day. Orders placed on Saturday or Sunday before 22:30 will be delivered by Tuesday at the latest.
- The entrepreneur endeavors to deliver within the stated timeframes but may experience delays due to high demand or unforeseen circumstances. Consumers will be notified promptly.
- The risk of damage or loss of products lies with the entrepreneur until delivery to the consumer.
Article 10 - Warranty
- All products come with a 1-year commercial warranty covering manufacturing and material defects. This warranty does not affect the statutory rights of the consumer.
- Damage caused by misuse, normal wear and tear, or modifications to the product is not covered by the warranty.
- The reduction in lithium-ion battery capacity in our wireless earbuds and the power bank of our heated blanket over time is normal wear and tear and is not covered by the warranty.
Article 11 - Complaints Procedure
- Complaints about the execution of the agreement must be submitted promptly, clearly described, and within a reasonable timeframe after the defect is noticed.
- Complaints will be responded to within 14 days. If a longer processing time is required, the consumer will receive an acknowledgment and a timeframe for resolution.
Article 12 - Disputes
- Contracts between the entrepreneur and the consumer are governed by Dutch law for Dutch customers and UK law for UK customers.
- Disputes are preferably resolved through mutual agreement.
Article 13 - Privacy
- The entrepreneur processes personal data solely for order processing and delivery purposes.
- Personal data will not be shared with third parties unless necessary for contract execution.
Article 14 - Promotions and Discounts
- Discounts and promotions cannot be combined unless explicitly stated otherwise.
Article 15 - Final Provisions
- Deviations from these terms are only valid if agreed upon in writing.
- If any provision in these terms is deemed invalid, the remaining provisions shall remain fully effective.
